Probate literally means “to publish.” The probate process is a public process by which the Will, if there is one, is published, or admitted to probate and the assets of the deceased are passed to his or her beneficiaries, which the law calls “heirs,” which are often the spouse or children of the deceased person. This process can take months to years to complete, depending on the size of the deceased person’s estate, and the number of assets. Filling out the proper court forms and administering the estate can be daunting. And, what is more, the court is often of little help as the clerks are not allowed to give legal advice. Also, it is not always necessary to “open the estate” and begin the process; however, once you do, there is no going back; it’s too late! You are stuck in the administration process until the process is complete.
